Risk and helplessness of children and adolescents resulting from addictive substances and behaviors
Protecting the best interests of children and adolescents requires that parents fulfill their parental responsibilities to meet their basic needs, including material, physical, educational, emotional, and affective needs. When parental duties are not adequately fulfilled due to addictive behaviors in parents and guardians, as well as in children, situations of risk and neglect may arise, requiring the intervention of public entities for the appropriate protection of these minors. This intervention should be proportionate, avoiding separating the child from their family unit whenever possible, and prioritizing family support measures over residential placement.
